These terms cover your use of jmdesignworks.net. They are not the contract for design work — if you hire us, we will agree that separately in writing before anything starts.

Who you are dealing with

This website is operated by Mattyar Asadi, trading as JM Design Works, based in Maple, Ontario, Canada. In these terms, "we" and "us" means JM Design Works, and "you" means anyone using the site.

By using the site you accept these terms. If you do not accept them, please do not use it.

Using the site

You may browse the site and contact us through it. You agree not to:

• Use it for anything unlawful
• Attempt to gain unauthorised access to it or to any system connected to it
• Submit false information, or send automated or bulk submissions through the contact form
• Copy or republish its content without permission

Enquiries are not a contract

Sending the contact form does not create any agreement between us, and neither does receiving a mockup or a quote from us. A project only begins once we have both agreed the scope and price in writing.

We may decline at any time

We may decline to provide a quote, decline to produce a mockup, or decline to take on a project, at any point and for any reason, without having to explain why. We may also stop work on a quote or mockup that is already under way.

This can happen for all sorts of ordinary reasons — the work is outside what we do, we do not have capacity, the brief is unclear, or it simply is not a good fit. Declining costs you nothing, and you are under no obligation to us either.

Nothing on this website is an offer capable of acceptance. Our prices, packages and the free mockup are invitations to get in touch, not commitments to work with everyone who does.

Prices and packages

The prices shown on this site are starting points for the packages described, not fixed quotes. What you actually pay depends on what your project needs, and we will confirm it in writing before any work starts.

We may change our prices at any time. A change will not affect a project we have already agreed with you.

The free mockup

We offer to design a mockup of your site before you pay anything. To be clear about what that means:

• The mockup is a design concept, not a working website.
• It costs you nothing and puts you under no obligation to continue.
• Until you have paid for a project, the mockup and its design remain our property. You may not take it to another designer or developer to build.

Paying for a project

How payment works

The mockup is free. If you like it and want to go ahead, we ask for 50% of the agreed price up front, and the remaining 50% once the site is finished, before it goes live.

Work begins once the deposit has cleared. The final payment is due before we publish the site or hand over any files.

If we cannot finish your site

If we are unable to complete your project for any reason on our side, we will refund your deposit in full and you will owe us nothing further. Any work we have produced up to that point remains ours and is not handed over.

If you cancel

You can cancel at any time. What happens to your deposit depends on how far the work has progressed:

• Before we start building — if we have not yet begun work on your site, we will refund the deposit.
• Once work is under way — the deposit is non-refundable. It covers the time already spent on your project, which we cannot recover.
• Once the site is substantially built — we keep the deposit, and we may invoice for work completed beyond what the deposit covers, up to the agreed project price.

If you are unsure where your project sits, ask us and we will tell you plainly before you decide.

Ownership until paid

Designs, code and files we produce remain our property until the project has been paid for in full. Once final payment is received, ownership of the finished website transfers to you and it is yours outright.

This means a site that has not been paid for cannot be published, transferred to another developer, or used in any form.

Support after launch

Post-launch support periods vary by package and are set out on the pricing section of this site. Our care plan is a separate monthly service, billed separately, and can be cancelled at any time.

Our content

Everything on this site — text, design, layout, graphics, code and logo — belongs to JM Design Works unless stated otherwise. You may view it and share links to it. You may not copy, republish or reuse it commercially without our written permission.

Work we show

Some examples shown on this site are illustrative, and are included to demonstrate the style and structure of the work we produce rather than to represent completed client projects. Where a project was produced for a client, it is shown with their permission.

Any names, brands or trade marks appearing in illustrative examples are used for design purposes only and do not imply any association with, or endorsement by, a real business of that name.

Links to other sites

Where we link elsewhere, we do not control those sites and are not responsible for their content or their handling of your information.

No warranties

We work to keep this site accurate and available, but we provide it "as is". We do not warrant that it will always be available, that it will be free of errors, or that the information on it is complete or current.

Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect or consequential loss arising from your use of this website, including lost profits, lost business or lost data.

Nothing in these terms limits liability for anything that cannot legally be limited, including fraud or personal injury caused by negligence.

This section is about the website. Liability relating to design work we carry out for you is dealt with in the agreement for that project.

Privacy

How we handle information about you is set out in our privacy policy.

Governing law

These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Any dispute will be dealt with by the courts of Ontario.

Changes to these terms

We may update these terms. The current version is always the one on this page, and the date at the top tells you when it last changed.
